Frequently asked questions FAQs
Division 7A is an anti-avoidance provision in Australian tax law. When a private company makes a loan or advance to a shareholder or their associate that is not repaid before the lodgment date, it can be treated as an unfranked dividend, creating heavy personal tax bills. We establish complying loan agreements and benchmark interest repayments to keep you protected.
Under ATO guidelines and trust law, trustees must formally resolve how trust income will be distributed on or before 30 June of each financial year (or an earlier date if stipulated in the trust deed). Failing to make a timely resolution can result in the trustee being taxed on the entire net income at the top marginal tax rate of 45%.
